Terms of service

These terms are an agreement between you and nith. They cover your use of nith: the page builder, the dashboard, and the sites, forms and leads board you run with it.

When these terms say “we” or “us”, they mean nith. When they say “you”, they mean the person or business that holds the account.

By creating an account or using nith, you agree to these terms. If you use nith for a business, you agree to them for that business, and you confirm that you are allowed to.

You need an account to build a site. Give us your real name and an email address you check, and tell us if that address changes. It is where we send notices about your account and your sites.

Keep your password to yourself. You are responsible for what happens under your account, including what the people you invite to your sites do there.

If you think somebody else has got into your account, tell us straight away.

You can use nith on the Free plan without paying. The paid plans, and what each one includes, are listed on our pricing page.

Paid plans are billed through Stripe, which handles your card details. We never see or store your full card number.

The published plans have no contract. You can cancel a paid plan whenever you like. If you cancel, or stop paying, your site goes back to the Free plan.

Custom arrangements are different. They come with their own written agreement, described in section 8.

What you put on your site stays yours: your words, pictures, products, posts and the records in your collections. You give us permission to store, copy and show it only as far as we need to run your site and the service.

You need the right to use everything you publish. That includes images, fonts, videos and any code you add to your site.

Your site’s forms collect information from your visitors, and their answers arrive on your leads board. You decide what your forms ask and what you do with the answers, so you are responsible for telling your visitors how you use their information, usually in your own privacy policy. We store and handle that information for you, on your instructions. Our privacy policy explains this in more detail.

Jot is the assistant built into nith. It can draft pages, posts, products, settings and records, write search text and make images. You never have to use it: everything Jot can do, you can also do yourself.

Jot only drafts. Nothing it suggests changes your site until you press to apply it.

Jot can get things wrong, so read what it drafts before you use it. You are responsible for what you publish, whether you wrote it or Jot did.

To draft for you, Jot sends your request, and the content it needs to work on, to an AI provider. Our privacy policy names the provider.

Do not use nith to:

• break the law, or help somebody else break it
• publish anything you do not have the right to use
• mislead people, collect their information by deception, or pretend to be somebody else
• send spam, or gather people’s details so that somebody else can
• harm the service or other people’s sites, for example by trying to get into accounts that are not yours, overloading the service or uploading harmful code

If a site breaks these rules, we may take it offline or suspend the account while we look into it. Where we can, we will tell you first and explain why.

A site manager runs sites for other businesses from one account. When you manage a site for a client, you act on that client’s behalf, and you are responsible for having their permission to do what you do on their site.

You can invite people to work on a site with you. Each person needs their own account and agrees to these terms. Each site is billed on its own.

When a site is ready, you can hand it to its owner. You offer the site to them, and once they accept, the site belongs to their account.

Some businesses work with us on a custom or managed arrangement instead of a published plan. Those arrangements have a written contract. Where that contract and these terms disagree, the contract decides for that arrangement.

You can stop using nith at any time. To close your account completely, contact us and we will close it for you. Before you do, copy anything you want to keep, and hand any client sites to their owners.

We may suspend or close an account that seriously or repeatedly breaks these terms.

We work hard to keep nith running and your information safe, but we provide the service as it is. We cannot promise that it will never be interrupted or never make a mistake.

As far as the law allows, we are not responsible for indirect losses, such as lost profits or missed enquiries. Nothing in these terms limits any responsibility that the law does not allow to be limited.

The law that governs these terms will be confirmed before they take effect.

We may update these terms as nith changes. The date at the top of this page shows when they last changed. If a change affects how you use nith, we will email you before it takes effect.
