Effective date: Not yet in effect
Version: Provisional draft

1. Scope

This Acceptable Use Policy forms part of the Terms of Service for Services provided by nith Studio LLC (nith). It applies to accounts, hosted sites, forms, uploads, documents, AI inputs and outputs, agency tools, commerce, integrations, and other use of the Services. Defined terms have the meanings given in the Terms of Service. Customers must ensure their Authorized Users and anyone they authorize to operate their sites follow this Policy.

The AI and Beta Terms and Agency and Commerce Terms contain additional requirements for those features. A feature's technical ability to accept material does not establish that the material is permitted, safe, or legally compliant.

2. Unlawful, deceptive, and harmful activity

You must not use the Services to conduct, promote, facilitate, or conceal unlawful activity. In particular, you must not:

  1. Defraud people, operate phishing or credential-harvesting pages, disguise the identity of a seller or sender, fabricate material business credentials, or impersonate another person or organization without authority.
  2. Publish threats of violence, facilitate violent wrongdoing, target a person with serious harassment, disclose private information to facilitate harm, or encourage exploitation or abuse.
  3. Create, possess, solicit, distribute, or facilitate child sexual abuse or sexual exploitation, or distribute non-consensual intimate imagery, including synthetic imagery depicting an identifiable person.
  4. Infringe intellectual property, privacy, publicity, confidentiality, or other rights; publish unlawfully obtained information; or falsely claim authority to license material belonging to another person.
  5. Offer unlawful goods or services, evade legally required age or eligibility restrictions, or use payment or delivery methods designed to evade sanctions or applicable law.
  6. Make deceptive product, professional, health, earnings, pricing, or availability claims; fabricate testimonials or reviews; or conceal material sponsorships or other relationships where disclosure is required.
  7. Use AI-generated material to carry out any of these activities or misrepresent an AI-generated statement as a verified fact, credential, endorsement, or statement made by a real person.

Lawful content can still violate this Policy through the manner in which it is used, such as unauthorized access, harassment, or spam. Additional category restrictions for regulated or age-restricted businesses, if any, must be expressly communicated in the applicable service or payment requirements.

3. Security and platform integrity

Do not access an account, site, system, or record without permission; evade access controls; exploit another customer's credentials; or exceed the scope of access granted to you. Do not upload malware, deploy credential theft, interfere with another customer's service, or attempt to extract nonpublic system instructions, credentials, or other customers' data through AI prompts or connected tools.

Do not intentionally overload, disrupt, or damage the Services or use them as infrastructure for attacks on other systems. Do not bypass payment, rate, storage, task, or permission limits through repeated accounts, deceptive identities, automated claims, or other evasive conduct. You may automate legitimate activity only through available interfaces and within the permissions and limits applicable to your account.

Security testing requires advance written authorization identifying its scope. Send vulnerability reports to To be confirmed: security report contact using the reporting instructions provided there. Do not access unrelated data, retain unnecessary copies, publish a working exploit before coordinated review, or demand payment as a condition of stopping harmful activity. This section does not create a bug bounty or promise payment. Rights that applicable law protects are not restricted by this Policy.

4. Information you collect, upload, and share

Collect and process personal information only with a valid legal basis, appropriate notices, and required consent or other authorization. Do not buy, scrape, disclose, or use personal information in violation of applicable law or another person's rights. Do not use forms or AI features to trick a person into revealing credentials or information unrelated to a disclosed purpose.

Unless nith has expressly approved the use in writing and the required contractual and technical safeguards are in place, do not submit protected health information subject to HIPAA, full payment-card numbers or card security codes, financial-account access credentials, government identification numbers, biometric identifiers used for identification, or other information that requires specialized regulated handling. A payment processor's own hosted payment fields are subject to its separate supported use; this exception does not authorize collecting card details in ordinary nith forms, documents, or AI prompts.

Do not use the Services for a child-directed service or submit information about children in a way that requires special parental-consent or child-privacy controls unless we have specifically agreed to support that use. The account eligibility rule does not eliminate a site operator's obligations to children who visit its site.

Public pages, shared passwords, unlisted links, and emailed signing or download links have different access properties. Use each only for its intended purpose. You must maintain permission to disclose information to AI providers or other integrations before using a feature that transmits it. Internal or unpublished content can still be processed by an enabled assistant or accessed for authorized platform support as described in the Privacy Policy.

5. Messaging and marketing

Use current email and notification features only for their supported purpose. Lead-alert and account email allowances do not authorize tenant bulk newsletters, marketing automation, or a general-purpose mailbox. If tenant marketing features are later made available, this section will apply to their use together with the feature-specific terms and controls disclosed at launch.

For any message you cause to be sent through or in connection with the Services, accurately identify the sender and subject, have permission or another lawful basis where required, and maintain records needed to demonstrate lawful sending. Do not use purchased, harvested, or fabricated contact lists to send unwanted messages through nith. Do not disguise marketing as a password reset, receipt, security notice, or other transactional message.

For commercial email, provide legally required sender details, advertisement identification, a valid postal address, and an accessible opt-out method, and honor opt-outs within the period required by applicable law. Do not charge for opting out, obstruct the process, or re-add suppressed recipients without a lawful basis. A recipient's purchase or account registration does not eliminate applicable marketing rights. Maintain suppression information only for lawful purposes and respect restrictions on its transfer.

You are responsible for the lawful content and audience choices you control, including messages sent in an agency's name. nith retains responsibility for its own applicable obligations. Using a service provider does not contract away a party's legal duties. We may limit sending or stop using a domain when necessary to address unlawful messages, provider restrictions, security, or material delivery abuse.

6. Content rights, custom code, and resource use

Use only media, fonts, software, data, and other content you have the right to use for the intended purpose. A stock search result, public URL, competitor website, generated image, or uploaded reference does not establish a license or permission to reproduce it. Retain required notices and obtain releases where needed.

You are responsible for custom scripts, embeds, styles, external links, and integrations you add. Do not use them to steal data, defeat consent choices, bypass access restrictions, mislead visitors, hide required disclosures, or impair the Services. A preview, sanitizer, or AI review is not a guarantee that custom code is safe. Where the Free plan requires nith attribution, do not hide or remove it through code, styles, overlays, or other circumvention.

Use resources for the websites and supported workloads your plan permits. Do not use hosted storage primarily as an unrelated file distribution service, malware repository, or infrastructure intended to degrade other customers' service. Technical rate and capacity limits may apply even when a feature has no recurring usage charge. We may take proportionate steps to protect service availability and will explain material account restrictions where practicable. This provision does not create an undisclosed bandwidth fee or permit retroactive usage charges; commercial changes follow the Terms of Service.

7. Reports, enforcement, and review

Report suspected violations to To be confirmed: abuse report contact. Identify the relevant site or URL, explain the conduct, and provide enough information to investigate. Do not submit passwords, payment credentials, or unnecessary sensitive information. If someone is in immediate danger, contact the appropriate emergency service; this reporting channel is not an emergency response service.

We may investigate credible reports and take proportionate measures under the Terms of Service, including restricting an affected feature, removing or disabling access to content, pausing sending, suspending credentials, or terminating an account for serious or repeated violations. Where practicable and lawful, we will explain the reason and allow correction or a response. Immediate action may be necessary to address imminent harm, compromised access, unlawful material, or a legal requirement.

You may request review of a moderation decision at To be confirmed: moderation review contact and provide relevant facts. We will consider a timely good-faith request without requiring you to waive a legal remedy. To be confirmed: approved moderation review process and timing. A review request does not automatically restore restricted access. We may limit disclosure where needed to protect another person's privacy, an investigation, or system security.

We may preserve and disclose relevant information when law requires or permits it, consistently with the Privacy Policy and applicable data-processing obligations. We do not promise to inspect all content or detect every violation, and accepting content into the Services is not an endorsement. Other people's contractual or statutory rights are unaffected by our moderation decision.

Copyright claims concerning material hosted through nith may be sent to the designated copyright agent at To be confirmed: dmca agent name, To be confirmed: dmca agent postal address, To be confirmed: dmca agent phone, To be confirmed: dmca agent email. Use the statutory notice process only if you are the rightsholder or authorized to act for the rightsholder.

A notice should identify the copyrighted work, identify the allegedly infringing material and its specific location, provide contact details and a physical or electronic signature, state a good-faith belief that the challenged use is unauthorized by the rightsholder, its agent, or law, and affirm that the notice is accurate and, under penalty of perjury, that the sender is authorized to act for the owner of the allegedly infringed exclusive right.

If we remove or disable material in response to a qualifying notice, we will take reasonable steps to notify the affected subscriber. A subscriber who believes removal resulted from a mistake or misidentification may submit a counter-notice containing a signature, identification and former location of the material, contact details, and a statement under penalty of perjury of that good-faith belief. It must also consent to the jurisdiction of the federal district court for the subscriber's address or, if outside the United States, a district where nith may be found, and accept service from the original complainant or its agent.

For a qualifying counter-notice, we provide it to the complainant and follow the applicable statutory restoration procedure. Ordinarily, restoration occurs between 10 and 14 business days after receipt unless the designated agent receives notice of a court action seeking to restrain the allegedly infringing activity. Separate, lawful restrictions under this Policy may continue to apply. Knowingly material misrepresentations in notices or counter-notices can create liability. We may disclose relevant notice information to the affected parties for this process.

nith will maintain and reasonably implement a policy to terminate, in appropriate circumstances, subscribers who are repeat infringers, and will accommodate applicable standard technical measures as required by law. Other intellectual property or privacy complaints may use the general abuse channel; a copyright notice is not the correct process for every disagreement about content.
